No Guarantee on ICE Near Polls, Organizers Prepare Anyway

The administration says ICE has no plans to target polling places, but its assurances come with exceptions. Voting-rights and immigrant groups are training monitors and lawyers for the gap.
Whether immigration agents will appear at polling places in November remains unsettled. In February, White House Press Secretary Karoline Leavitt said "I can't guarantee that an ICE agent won't be around a polling location," and called the question "a very silly, hypothetical question." Since then, a DHS spokesperson has said "ICE is not planning operations targeting polling locations," while reserving the right to change course based on intelligence. Secretary Markwayne Mullin has said ICE would be at polls only if there is a threat to the site or it is serving a warrant on someone it has been tracking.
Federal law, 18 U.S. Code 592, bars "troops or armed men" at polling places. The ban dates to the Civil War, and Congress removed a "keeping the peace" exception in 1909, according to PolitiFact. Democrats, voting-rights groups and unions filed multiple lawsuits in September asking courts to block deployments. One suit, brought in federal court in Washington by LULAC, UnidosUS, Common Cause and Denver officials, challenges what it calls an administration policy allowing ICE operations at polling sites.
Organizers are not waiting for a ruling. The Vote Safe coalition, launched September 2 and led by Rev. Al Sharpton and AFT President Randi Weingarten, is training volunteers as poll observers in Georgia, Michigan, North Carolina and Ohio. Chicago election officials have retained outside counsel and are staffing field investigators. A Strength In Numbers/Verasight poll, taken September 16-21, found Americans opposed sending immigration agents to polling places by a net 30 points.
Notice the pattern: when a denial carries its own exceptions, the exceptions become the plan that everyone else has to prepare for.
